Advocate Aurora Health, Inc. maintains this password protected website (“Portal”) to provide an interactive online video visit with an Aurora Health Care Medical Group provider about health issues for a service fee (“Service”). Your access to the Portal and use of the Service is subject to these Terms of Use. These Terms of Use are an agreement between you and Advocate Aurora Health, Inc., including its affiliates (“Advocate Aurora” or “we”) with regard to your use of the Services through this Portal. Throughout these Terms of Use, "you" means the person who clicks "I Agree" below. However, if you are clicking "I agree" on behalf of a minor as his or her legally authorized representative, then "you" means the authorized representative and the person represented, but in that case the Service may only be used for the benefit of the minor represented.
Your agreement
THESE TERMS OF USE ARE A LEGALLY BINDING DOCUMENT. PLEASE READ IT CAREFULLY. BY CLICKING "I AGREE" BELOW OR OTHERWISE USING THE SERVICE, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS OF USE; AND (B) AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OF USE OF USE, CLICK "I DO NOT AGREE" AND THEN YOU ARE NOT PERMITTED TO USE THE SERVICE AND SHOULD PROMPTLY EXIT THIS PORTAL. Summary
The following is a summary of the agreement between you and Advocate Aurora. Reading this does not substitute for reading and understanding this entire document. If you click on "I agree" or otherwise use the Service, you agree to all these Terms of Use below.
- Video Visits are not for conditions requiring emergency care.
- You must be: (1) a resident of Illinois and be physically present in the State of Illinois when using the Service; (2) be a resident of Wisconsin and be physically present in the state of Wisconsin when using the Service; or (3) a resident of Michigan and be physically present in the State of Michigan when using the Service.
- Your request for a Video Visit must be for your own condition or on behalf of a minor as his or her legally authorized representative.
- You will be billed directly for this Video Visit. We will not bill your insurance. We will provide you with a receipt and claim form for your service that you may submit to your insurance plan.
- Any prescriptions filled, or additional tests or services ordered and received will be billed separately. They are not considered part of the Video Visit.
- We will only treat specified non-chronic conditions by Video Visits. Other conditions require a face-to-face visit with a provider.
- If your condition cannot safely be treated as a Video Visit, we will recommend a face to face visit with a provider, and you will not be charged for the Video Visit.
- Your Video Visit will be addressed by a primary care or urgent care provider. The provider may not be your normal primary care provider.
Changes to these terms of use
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
Your representations
You represent and warrant that you are at least 18 years of age, that you are physically located in the State of Illinois, Michigan or Wisconsin, as applicable, and that you possess the legal right and ability to be legally bound by these Terms of Use and to use the Service. If you are accessing the Service on behalf of a minor, then you represent and warrant that you are his or her legally authorized representative.
You agree to be financially responsible for your use of the Service and to comply with your responsibilities and obligations as stated in these Terms of Use.
If you are not 18 years of age, you are not permitted to use the Service and must exit this Portal now.
Video visits
A Video Visit is an online exchange of medical information between a patient and a health care provider where the provider gives the patient medical advice via online secure communication. Video Visits can be used only for non-urgent symptoms.
You will be asked to provide information on your medical conditions, allergies and medications before the Video Visit begins (the “PreCheck-In”). The PreCheck-In provides the health care provider the information needed to treat you. It is important that the PreCheck-In information is true and accurate.
Video Visits are not a substitute for regular in-person visits in which a doctor or other qualified provider takes a history from a patient, conducts a physical examination and orders and interprets the appropriate diagnostic tests.
A request for a Video Visit can be submitted between 7am - 9pm. We address requests for Video Visits on a first-come-first serve basis. We do not guarantee any specific response time. If you do not receive a response, or if your symptoms get worse, you should call your doctor's office.
We will only offer treatment by Video Visits for non-urgent symptoms. At any time during the Video Visit, we may terminate the Video Visit and advise you to seek treatment through a face-to-face encounter with a provider, or, if your PreCheck-In information suggests that your symptoms are emergent, we may recommend you seek care at the closest emergency room. If we do not complete the Video Visit, we will not charge you for the Service.
If you are experiencing symptoms like shortness of breath, chest pain, dizziness, weakness, confusion, high fever, sudden or major bleeding, severe rashes or hives, severe allergic reactions, or any other symptoms that might suggest a serious condition, CALL YOUR DOCTOR'S OFFICE, VISIT THE NEAREST HOSPITAL EMERGENCY DEPARTMENT, OR DIAL 911 IMMEDIATELY.
Because our health care providers are licensed in Illinois, Michigan, and Wisconsin, you may not use Video Visits if you are physically located outside the States of Illinois, Michigan or Wisconsin. With the exception of minors for whom you are the legal representative, you may not send requests on behalf of someone else, or about someone else's health.
Our fees for the Service may change from time to time, and you agree to pay for all charges.
The information you provide as part of the Video Visit is generally held confidential, but may be disclosed by us in accordance with our Notices of Privacy Practices located at: https://www.advocatehealth.com/privacy-policy/notice-of-privacy-practices and https://www.aurorahealthcare.org/privacy-policy/notice-of-privacy-practices. In addition, your use of the Service is subject to Advocate Aurora’s Privacy Policy located at: https://www.advocatehealth.org/livewell/privacy.
By using the Service, you acknowledge that any previous consents given by you to Advocate Aurora will also apply to Video Visits.
Credit card and payment card information
Video Visits require a valid credit or payment card for payment. You must submit credit card or payment card information via the Credit Card Payment Portal to pay for Services. You must submit the necessary card information before your Video Visit will be processed. If the card information that you submit is incorrect or invalid, your Video Visit will not be processed. Payment is subject to the approval of the financial institution issuing the card. We assume no responsibility or liability if the financial institution refuses to accept or honor your card for any reason.
Restrictions on your use
You may view materials from this Portal only for your own personal use. You may not download, reproduce or otherwise distribute any materials on this Portal without our prior express written consent and/or the consent of any third-party copyright owner.
Advocate Aurora reserves all rights not expressly granted to you by these Terms of Use or any applicable end user license agreements.
You may not use this Portal or its content for any purpose prohibited or restricted by law or in violation of these Terms of Use.
No warranty
THIS PORTAL AND THE SERVICE ARE PROVIDED "AS IS," WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND DISCLAIMS ALL SUCH WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT AND ALL WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE IN TRADE.
ADVOCATE AURORA MAKES NO WARRANTY OR REPRESENTATION REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USE OF THIS PORTAL, OR USE OF MATERIAL, INFORMATION OR DATA DOWNLOADED OR OTHERWISE OBTAINED FROM THIS PORTAL, OR REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THIS PORTAL. ADVOCATE AURORA DOES NOT HAVE ANY RESPONSIBILITY FOR THE TIMELINESS, DELETION, MISDELIVERY OR FAILURE TO STORE ANY USER COMMUNICATION.
No advice or information, whether oral or written, obtained by you from Advocate Aurora in any manner through this Portal creates any warranty by Advocate Aurora.
Limitation of liability
NEITHER ADVOCATE AURORA OR ITS AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS ARE RESPONSIBLE OR LIABLE TO YOU UNDER ANY THEORY OF LIABILITY OR INDEMNITY IN CONNECTION WITH YOUR ACCESS OR USE OF THE PORTAL OR ANY OF ITS CONTENT OR SERVICES. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
FURTHERMORE, NEITHER ADVOCATE AURORA OR ITS AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS ARE OR WILL BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES OF ANY KIND ARISING OUT OF OR RELATING IN ANY WAY TO THE PORTAL, THE SERVICE, AND/OR ANY CONTENT ON THE PORTAL, WHETHER SUCH DAMAGES ARE BASED IN TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVOCATE AURORA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PORTAL OR THE SERVICE AND/OR ANY DAMAGE RESULTING FROM THE PORTAL OR THE SERVICE IS TO STOP USING THE SERVICE, EVEN IF SUCH REMEDY SHOULD FAIL ITS ESSENTIAL PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Indemnification
You agree to indemnify, defend and hold harmless Advocate Aurora, its affiliates, and their respective officers, directors, employees and agents from and against all losses, expenses, liabilities, damages and costs, including without limitation reasonable attorney fees, resulting from or arising from your use of the Portal or its content or any violation of these Terms of Use.
Disputes, choice of law and venue
All matters relating to the Portal and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Wisconsin, without giving effect to any choice or conflict of law provision or rule of any other jurisdiction.
You submit to the exclusive jurisdiction of the state and federal courts sitting in the County of Milwaukee in the State of Wisconsin and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
In any action to enforce these Terms of Use, Advocate Aurora will be entitled to all costs and attorney fees it incurs.
Any cause of action or claim you have regarding the Portal or the Service must be commenced within one year after the claim or cause of action arises or the claim or cause of action is barred.
Notice may be given to you as a user of this Portal by posting information to this Portal. Notice may be given to Advocate Aurora only by delivery to Aurora Public Relations Department, 750 West Virginia Street, P.O. Box 341880, Milwaukee, WI 53234-1880, with a copy to General Counsel at the same address.
